Wrong microcontroller in with-vreg.sch

Hello,
In my opinion wrong uC is used in with-vreg.sch schematic example, because as far as I know Atmega8-16P cannot be supplied from 3,3V. On the other hand Atmega8L-16P can be supplied from 3,3V but it's rated up to 8Mhz or maybe I'm missing something.
